Pursuant to Writ of Execution issued in Case No. 22-C-10-001815 in the Circuit Court for Wicomico County, Maryland , I have levied upon, seized and attached as Sheriff of Wicomico County, Maryland, all of the right, title, claim, estate and interest of Kevin Twilley in and to the following parcel of real estate.

I hereby give public notice that on Friday, September 29, 2017, at 10:00 a.m., I will offer for sale at public auction at the Circuit Court for Wicomico County Court House, at 101 North Division Street, (North Division Street Entrance) Salisbury, Maryland 21801, all the right, title, estate, claim and interest of Kevin Twilley, in and to the following real property:

All that piece or parcel of ground situate and lying in Tyaskin Election District of Wicomico County, Maryland, located on the northwesterly side of and binding upon Nanticoke Road, consisting of two parcels of land collectively known as 23124 Nanticoke Road, Quantico, Maryland 21856, and identified as Parcel 19 on Wicomico County Tax Map 44, as by Tax Accounts Numbers 03-000451 and 03-000478; and being the same land conveyed to Kevin Twilley by deed dated July 31, 2015, and recorded among the Wicomico County Land Records at Liber M.S.B. No. 3897, Folio 208.

The property is described on tax assessment map aforesaid as containing a total of approximately 64,050 SQ FT of land and is improved by a residential dwelling.

TERMS OF SALE: The successful bidder purchases all right, title, claim and interest of the judgment debtor and is buying subject to prior liens of record, including specifically a judgment lien in the original amount of $6,694.64 recorded in 22-L-16-000815 in the Circuit Court for Wicomico County, Maryland. The outstanding balance will be announced at the sale.  The parcel has not been surveyed, so no representation or warranty can be made regarding acreage, and neither is there any representation being made as to title or the condition of the land or improvements. The successful bidder(s) at the Sheriff’s sale will take the property as is, where is, with all faults and defects of any kind, with no representation or warranty of any kind, including any warranty of merchantable title. Buyers are encouraged, therefore, to satisfy themselves concerning any issues of title, condition or acreage prior to the sale.

A deposit of $5,000.00 in cash, certified check, money order, cashier’s check or check approved in advance of the sale by the auctioneer and Sheriff’s Department of Wicomico County will be required of the purchaser at the time and place of sale, and settlement shall occur within fifteen days of ratification of the sale by the Circuit Court for Wicomico County. The successful bidder(s) will be required to sign at the time of sale a contract to purchase the Parcel consistent with the above terms. The deferred portion of the purchase price shall be evidenced by the promissory note of the Buyer, bearing no interest provided settlement is made and full price tendered on or before fifteen days after the date of ratification of the sale by the Circuit Court for Wicomico County, Maryland; otherwise the deferred portion to bear interest at the rate of six percent (6%) per annum. All settlement costs, including but not limited to, document preparation, recordation and transfer taxes, recording costs and title examination, if any, shall be the obligation of the buyer. All property taxes and all other public charges or assessments, including water/sewer charges, condo/HOA dues, whether incurred prior to or after the sale, and all other costs incident to settlement shall be paid by the purchaser.

The right to possession shall pass to the Buyer at closing, subject to any liens of record. The successful bidder purchases all rights, title and interest of the judgment debtor.

Neither the Wicomico County Sheriff’s Department nor any of its staff makes any representation or warranty regarding ownership, condition of the property, improvements, or as to the suitability of the property for any particular purpose or title of the property, and shall have no liability with respect to any matter involving the sale.
