SUBSTITUTE TRUSTEES’ SALE OF VALUABLE IMPROVED AGRICULTURAL (POULTRY) REAL ESTATE


commonly known as 5936 Newhart Mill Road, Rhodesdale, Maryland (Map 0025, Parcel 0073) Under and by virtue of the power and authority contained in a Deed of Trust from Mark K. Murphy and Traci L. Murphy, dated June 15, 2007 and recorded at Liber 814, folio159 in the Dorchester County Land Records, default having occurred under the terms thereof, the holder of the indebtedness secured by the Deed of Trust having appointed Alexis E. Kramer and Garrett M. Fitzgerald as Substitute Trustees by instrument duly executed, acknowledged and recorded among the Land Records of Dorchester County, the undersigned Substitute Trustees, will sell at public auction, at the Dorchester County Circuit Courthouse door, 206 High Street, Cambridge, Maryland on: October 11, 2018 at 10:00 a.m. ALL that lot, piece or parcel of land situate, lying and being in the Number One or Fork Election District of Dorchester County, Maryland, located on the north side of and binding upon Newhart Mill Road, beginning for the outlines of the same at an iron rod with cap set on the northerly side of Newhart Mill Road, said point of beginning being the southwesternmost corner of the property herein conveyed and the southwesternmost corner of the residue of lands of the Grantor, and running thence the following courses and distances: (1) by and with the northerly side of Newhart Mill Road, south 50 degrees, 39 minutes, 26 seconds west a distance of 661.87 feet to an iron rod with cap set in the ground; thence (2) by and with the lands now or formerly owned by William Otis Bramble, et al., (Liber P.L.C. No. 227, folio 149), north 21 degrees, 14 minutes, 19 seconds west, a distance of 1,691.72 feet to an iron rod with cap set in the ground; thence (3) continuing by and with the aforesaid William Otis Bramble land, south 77 degrees, 00 minutes, 00 seconds east, a distance of 722.63 feet to an iron rod with cap set in the ground; thence (4) running by and with the residue of the Grantor’s land (Liber R.S.M. No. 96, folio 175), south 22 degrees, 55 minutes, 15 seconds east a distance of 1,079.93 feet to an iron rod with cap set on the northerly side of Newhart Mill Road and the place of beginning, containing 19.47 acres of land, more or less, and being more particularly shown and designated on a plat entitled “Subdivision of PropertyBelonging to Lena C. Wilckens”, prepared by Tim Marshall & Associates, Inc., dated October 20, 1997 and recorded among the Plat Records for Dorchester County, Maryland, in Plat Cabinet No. 45, folio 141A. BEING the same land which was granted unto Mark K. Murphy and Traci L. Murphy, his wife, by deed from Lena C. Wilckens dated February 19, 1998 and recorded among the Land Records of Dorchester County in Liber M.L.B. No . 370, folio 817. TERMS OF SALE: A cash deposit or certified funds of $25,000.00 shall be paid at the time and place of sale, balance in cash at settlement, which shall be 20 days after final ratification of the sale by the Circuit Court for Dorchester County, unless said period is extended by the Substitute Trustees for good cause shown, time being of the essence; interest at the rate of 7% per annum shall be paid on the unpaid purchase price from date of sale to date of settlement. Purchaser shall be responsible for obtaining physical possession of the property. Purchaser assumes the risk of loss or damage to the property from the date of sale forward. If the Substitute Trustees are unable to convey good and merchantable title, purchaser’s sole remedy shall be limited to a refund of the deposit and cancellation of the sale. In the event the purchaser fails to go to settlement as required, the property will be resold at purchaser’s risk and expense. Purchaser consents to the personal jurisdiction of the Maryland Courts. The property is sold in an "AS IS" condition and subject to covenants, conditions, easements, declarations,restrictions, by-laws and plats, and utilityagreements of record, if any, affecting the property. Taxes shall be prorated as of the date of sale and assumed thereafter by the purchaser. All other outstanding public charges or public assessments, including but not limited to water, rent, front foot benefit, condominium fees, sewer, sanitary and/or City, County or Town charges, as well as any tax sale amounts, costs and/or attorney’s fees, shall be paid by purchaser whether incurred prior to or after the sale. All quantities of land are "more or less," without survey or warranty. Information contained herein is believed accurate but is without warranty. Costs of any agricultural taxes and all recording fees, transfer taxes, document preparation and title examination and insurance shall be borne by purchaser, i.e., contrary to those provisions of the Maryland law which would, in the absence of this stipulation, require that recording and transfer taxes be divided equally between the seller and the buyer. Purchaser agrees to pay a reasonable fee for any other services rendered by seller’s attorney at the request of purchaser or due to purchaser’s failure to comply with the terms of the sale. The Substitute Trustees reserve the right (i) to waive or modify the deposit requirement; (ii) to approve the creditworthiness of any bidder or final purchaser; (iii) to withdraw all or part of the property from sale at any time prior to the termination of bidding; (iv) to keep the bidding open any length of time; (v) to reject any or all bids; and (vi) to postpone the sale, all as the Substitute Trustees may determine in their sole discretion.
