Under and by virtue of the power and authority contained in a Purchase Money Deed of Trust from Ghousia Farm, LLC dated July 29, 2016 and recorded at Book 1344, Page 446 in the Dorchester County Land Records, default having occurred under the terms thereof, the holder of the indebtedness secured by the Deed of Trust having appointed Alexis E. Kramer and William C. Chapman as Substitute Trustees by instrument duly executed, acknowledged and recorded among the Land Records of Dorchester County, the undersigned Substitute Trustees,


will sell at public auction, at the Dorchester County Circuit Courthouse door, 206 High Street, Cambridge, Maryland on: March 30, 2021 at 12:00 p.m.


ALL those three parcels of land situate, lying and being on the east, west and south sides of Hawkeye Road in the East New Market and Linkwood Election Districts of Dorchester County, Maryland and being those three parcels of property designated as “Parcel A, Area = 51.65 Acres±”, “Parcel B, Area = 18.30 Acres± and “Parcel C, Area = 9.14 Acres±” upon a plat entitled “Plat Showing Survey of PropertyBelonging to James W. Phillips, Jr. & Catherine M. Phillips” prepared by Tim Marshall & Associates, Inc., dated January 5, 1994 and recorded among the Plat Records of Dorchester County, Maryland in Plat Cabinet P.L.C. No. 43, folio 295; and being all of Parcel “A”, “B” and “C” as shown and delineated upon the said Plat, containing a total of 79.09 acres of land, more or less; SAVING AND EXCEPTING THEREFROM THE PROPERTY CONVEYED BY THE FOLLOWING DEEDS: (1) deed for Lot 1, containing 4.31 acres of land, more or less (plat reference Liber 47, folio 272-B) conveyed to Gregory J. Warrell and wife and recorded in Liber 431, folio 453 on August 8, 2000; and (2) deed for Lot 2, containing 3.00 acres of land, more or less (plat reference Liber 47, folio 320-B) conveyed to Christopher J. Budd and wife and recorded in Liber 463, folio 25 on October 25, 2001. The net acreage to be conveyed herein is 71.78 acres of land, more or less.


TERMS OF SALE: A cashiers or certified check of $25,000.00 shall be paid at the time and place of sale, balance in cash at settlement, which shall be 20 days after final ratification of the sale by the Circuit Court for Dorchester County, unless said period is extended by the Substitute Trustees for good cause shown, time being of the essence; interest at the rate of 5.99% per annum shall be paid on the unpaid purchase price from date of sale to date of settlement. Purchaser shall be responsible for obtaining physical possession of the property. Purchaser assumes the risk of loss or damage to the property from the date of sale forward. If the Substitute Trustees are unable to convey good and merchantable title, purchaser’s sole remedy shall be limited to a refund of the deposit and cancellation of the sale. In the event the purchaser fails to go to settlement as required, the property will be resold at purchaser’s risk and expense. Purchaser consents to the personal jurisdiction of the Maryland Courts. The property is sold in an "AS IS" condition and subject to covenants, conditions, easements, declarations, restrictions, by-laws and plats, and utility agreements of record, if any, affecting the property. Taxes shall be prorated as of the date of sale and assumed thereafter by the purchaser. All other outstanding public charges or public assessments, including but not limited to water, rent, front foot benefit, condominium fees, sewer, sanitary and/or City, County or Town charges, as well as any tax sale amounts, costs and/or attorney’s fees, shall be paid by purchaser whether incurred prior to or after the sale. All quantities of land are "more or less," without survey or warranty. Information contained herein is believed accurate but is without warranty. Costs of any agricultural taxes and all recording fees, transfer taxes, document preparation and title examination and insurance shall be borne by purchaser, i.e., contrary to those provisions of the Maryland law which would, in the absence of this stipulation, require that recording and transfer taxes be divided equally between the seller and the buyer. Purchaser agrees to pay a reasonable fee for any other services rendered by seller’s attorney at the request of purchaser or due to purchaser’s failure to comply with the terms of the sale. The Substitute Trustees reserve the right (i) to waive or modify the deposit requirement; (ii) to approve the creditworthiness of any bidder or final purchaser; (iii) to withdraw all or part of the property from sale at any time prior to the termination of bidding; (iv) to keep the bidding open any length of time; (v) to reject any or all bids; and (vi) to postpone the sale, all as the Substitute Trustees may determine in their sole discretion.
