Pursuant to power of sale contained in a Mortgage filed for foreclosure in Case No. C-23-CV-18-000082 in the Circuit Court for Worcester County, Maryland, the undersigned will offer the following described real estate for sale to the highest bidder at public auction to be held at the front steps of the Worcester County Circuit Courthouse, One West Market Street, Snow Hill, Maryland, on

           

FRIDAY, MAY 4, 2018, at the HOUR OF 10:00 A.M.

 

ALL that lot, piece or parcel of land situate and lying in the Third (3rd) formerly Ninth (9th) Election District, Worcester County, Maryland, which is more particularly described as follows: Beginning at a point marked by a stake set at the angle of a ditch and at the end of the fourth (4th) and the beginning of the fifth (5th) line of a Deed from Calvin B. Taylor, Trustee, to Calvin H. Evans (said deed being dated the 8th day of August, 1905, and duly recorded among the Land Records of Worcester County, Maryland in Liber No. 23, Folio 184 and 185) and from thence running by and with the general course of said ditch the three following courses: North 65 degrees 00 minutes West .96 chains by and with the fifth (5th) line of the aforesaid Deed to a turn in said ditch; thence with the call contained within the 6th line of said Deed North 5 degrees 30 minutes West 4.10 chains; thence with the 7th line North 20 degrees 30 minutes East 1.31 chains to the west side of the county road leading from the Berlin-Showell State Stone Road to Friendship Station; thence by and with the southwest side of said county road South 54 degrees 15 minutes East 4.01 chains to a stake; thence South 36 degrees 15 minutes West 4.17 chains to the place of beginning; containing and laid out for 1.18 acres of land, more or less; the above courses and distances being the same as given in a survey made of the above property on the 26th day of September, 1936, with a variation of 2 degrees 37 minutes West by William D. Pitts, Surveyor. The above property being the same property which is indicated as the C.E. and M.S. Davis lot on the Plat which is attached to the Deed dated October 22, 1936, recorded among the Land Records of Worcester County, Maryland, in Liber No. 30, Folio 500, et seq.; and being the same land conveyed unto Brenda Kay Vallee by Deed from Robert Edward Wager, II, dated April 30, 2015, and recorded among the aforesaid Land Records in Liber S.R.B. No. 6554, Folio 233.

 

IMPROVEMENTS:  The property is improved by a residential dwelling known as 10344 Carey Road, Berlin, MD 21811, and is identified by tax account number 03-008622.  

 

TERMS OF SALE:   The property will be sold to the highest bidder at public auction.  The purchaser will be required to tender on account of the purchase price at the time and place of sale cash, certified funds, or check acceptable to the undersigned, in the amount of Ten Thousand Dollars ($10,000.00).  If the party secured by the Mortgage is the successful bidder, no deposit will be required, and the cash deposit or price shall be credited against the obligation.  The deferred portion of the purchase price shall be evidenced by the Promissory Note of the Buyer, bearing no interest provided settlement is made and the full price tendered on or before fifteen days after the date of ratification of the sale by the Circuit Court for Worcester County, Maryland; otherwise the deferred portion of the purchase price shall bear interest from the date of sale at the rate of 6% per annum.  Neither the Assignees nor the auctioneer make any representation or warranty concerning the property or the improvements, the same being sold “as is”; and, if for any reason the Assignees are unable to deliver good and marketable title, subject only to easements, rights of way and residential use restrictions of record, the sole and exclusive remedy of the Buyer shall be a refund of the deposit money.  Neither Assignees, auctioneer or note holder are aware of any violation of any federal, state or municipal environmental law or regulation; however, in the event any such violations exist, they are not responsible for same.  All settlement costs, including, but not limited to, document preparation, recordation and transfer taxes, including agricultural transfer tax, if any, recording costs, and title examination, if any, shall be the obligation of the Buyer.  State, County, and municipal property taxes and assessments, shall be adjusted as of the date of sale.   Buyer shall be entitled to possession upon final settlement and payment of the purchase price in full, which shall occur not later than fifteen days after final ratification of the sale by the Circuit Court for Worcester County, Maryland, time being of the essence.
